These Terms and Conditions (hereinafter the ‘T&Cs’) govern your registration with Jobs for Mums Malta owned by KATJA DINGLI BENNETTI, bearer of Maltese identity card number 0422503L, (hereinafter the ‘JFM’) having VAT number MT22248303
a. JFM advertises part-time and flexible job opportunities, including but not limited to term time jobs, home-working, temporary and project-defined jobs
b. JFM operates via a number of sources, one of which is the internet website www.jobsformumsmalta.com (the ‘Portal’), of which JFM is the authorized licensee;
c. Employers registering with JFM are authorising JFM to advertise and market their job vacancies which JFM caters for via the Portal and any other source managed by JFM as JFM deems fit..
By registering with JFM, you are accepting these Terms and Conditions which govern ruch registration with JFM .
(a) “Portal User” shall mean any individual accessing the Portal from time to time.
(b) “Listing Services” shall mean the marketing and advertising services provided by JFM to the Registered Employer as outlined in the Portal.
(c) “Listing Material” shall mean the information required by JFM from the Registered Employer for the advertising and marketing of job vacancies including data, images, videos, logos, trademarks, trade names and other information about the Employer as well as any such other material as JFM deems necessary.
(d) “Portal” shall mean the internet portal www.jobsformumsmalta.com.
(e) "Job Vacancy" or “Job Vacancies” shall mean any one or more vacancies which the Registered Employer provides to JFM for advertising and marketing purposes via the Portal and any other sources as JFM deems fit.
(f) “Registered Employer” shall mean the Employer or Agent who registered with JFM via the Portal and has been approved by JFM in accordance with these T&Cs;
(g) “Registering Material” shall mean the information required by JFM from the Employer for the purposes of registration.
2.1 Registration with JFM is free. Anyone desirous of registering with JFM shall provide the Registering Material required by JFM.
2.2 JFM reserves the right to refuse to accept any particular registration in its sole and absolute discretion.
2.3 JFM also reserves the right to cancel the registration of any Registered Employer in its sole and absolute discretion at any point in time.
3. PURCHASE OF JFM PACKAGES
3.1 The Registered Employer may choose to purchase packages offered by JFM for the advertising and marketing of Job Vacancies.
3.2 The Registered Employer shall provide JFM with the Listing Material requested and make the relative payment as directed by JFM.
3.3 The Registered Employer accepts and acknowledges that JFM shall only advertise and market Job Vacancies of the Registered Employer upon receipt by JFM of the Listing Material and the relative payment;
3.4 JFM reserves the right to refuse to advertise and market Job Vacancies in its sole and absolute discretion if:-
(i) The Listing Material is not provided in full by the Registered Employer;
(ii) Payment is not made by the Registered Employer;
(iii) The Registered Employer cancels his registration with JFM;
(iv) The Registered Employer acts in any way or manner which may bring JFM into disrepute;
(v) The Registered Employer is declared by any court or tribunal to have been violating employment laws and regulations, fundamental human rights or in any way discriminated on the basis of race, colour, gender, sex, religion or any political affiliation;
(vi) The Registered Employer is declared bankrupt or going through liquidation or bankruptcy proceedings;
(vii) JFM becomes aware that any Registering Material and Listing Material provided by the Registered Employer is in any way or manner incorrect, false and/or misleading.
3.5 JFM reserves the right to remove and cease from advertising and marketing any further any Job Vacancies for any of the reasons identified in clause 3.4. In this event, the Registered Employer who has already made payment accepts and acknowledges that he shall not have the right to any refund.
3.6 Once approved and the relative payment is received, JFM shall upload the Listing Material relating to the Job Vacancies provided by the Employer on the Portal within forty-eight (48) hours.
3.7 Any time period relating to the visibility and marketing of the Job Vacancies starts running from 48-hours following receipt of payment by JFM. Once the time-period expires, JFM may remove and cease advertising and marketing any Job Vacancies as well as remove any references thereto.
4. LISTING AND ADVERTISING THE JOB VACANCY
4.1 JFM will list and advertise any Job Vacancies of the Registered Employer in accordance with the Registering Material and Listing Material provided by the Registered Employer. JFM shall not be responsible for any inaccuracies, incorrect, erroneous, false or misleading information provided by the Registered Employer.
4.2 JFM does not provide any advice relating to any Job Vacancy advertised or marketed by it, nor in any way or manner, acts as a recruiter, intermediary or agent for or on behalf of the Employer or provide any recruitment agency services in any way or manner . It is hereby further being acknowledged and confirmed by the Registered Employer that JFM provides the Listing Services solely as a marketing medium and platform.
4.3 JFM is solely a third party and is not involved in any way or manner in any of the exchanges by and between the Registered Employer and the Portal User, including but not limited to the conclusion of any agreement/s by and between the Portal User and the Employer.
4.4 JFM reserves the right to place third party advertisements on any page within the Portal and on any other sources used for advertising and marketing including the page containing the Listing Material of the Employer as it deems fit.
4.5 A Portal User shall be free to obtain and access the Listing Material provided by the Portal. No registration is required.
4.6 A Portal User may contact a Registered Employer via the Portal regarding any of the Job Vacancies uploaded on the Portal and/or marketed and advertised by JFM
5.1 The Registered Employer may terminate his registration with JFM at any point in time at his sole and absolute discretion. Provided that the provisions of clause 3.4 of these T&Cs shall subsequently come into effect.
5.2 JFM shall have the right to terminate any registration of a Registered Employer at any point in time at its sole and absolute discretion for any of the reasons specified in clause 3.4 of these T&Cs, provided that the Registered Employer shall be notified in writing.
5.3 JFM reserves the right to claim any damages suffered from any Registered Employer whose registration is canceled for any of the reasons in accordance with clause 3.4.
6.1 Payment shall be made by the Registered Employer to JFM for any packages acquired via those methods as provided on the Portal.
7.1 The Registered Employer whose Job Vacancy is advertised and marketed by JFM warrants that it shall seek recruitment in good faith and shall endeavor to contact the Portal User who opts to apply for such Job Vacancy within a reasonable time.
7.2 The Registered Employer accepts and acknowledges that the Portal may at times not be available or down due to maintenance and/or any other occurrences which are beyond the control of JFM. The Registered Employer warrants that it shall hold JFM free from any liability deriving from any down time of Portal.
7.3 JFM warrants that it is the authorized licensee of all intellectual property rights inherent in the contents of the Portal, and the Registered Employer shall warrant that it is the rightful owner and/or authorized to provide to JFM any information provided.
7.4 The Registered Employer warrants that by providing the Registering Material and Listing Material to JFM, it is providing to JFM the necessary authorization to advertise and market any Job Vacancies in accordance with the package bought by the Registered Employer. Furthermore, the Registered Employer shall warrant that it has the authority to grant JFM permission to use the Listing Material provided by the Registered Employer to advertise and market such Job Vacancy as JFM deems fit.
7.5 The Registered Employer acknowledges that the use of the World Wide Web is at its risk and without any warranties or conditions whatsoever, express or implied. The Registered Employer acknowledges that no guarantee may be given that the Portal User will be able access the Portal at any particular time or from any particular location.
7.6 The Registered Employer warrants that it shall keep JFM free and harmless from any liability ensuing from any material provided by it;
7.7 The Registered Employer warrants that it shall not extract any information contained on JFM sources which is property of JFM, including but not limited to the Portal, without seeking prior authorisation from JFM in writing.
8.1 All information including, but not limited to, business and financial information and any other information relating to the business of the Registered Employer shall be treated with strict confidentiality.
8.2 Confidential information provided to JFM by the Registered Employer will not be divulged to any third party directly or indirectly without the explicit and written consent of the Registered Employer.
8.3 JFM obliges itself not to use the Confidential Information for any other purpose except for the performance of its obligations under these T&Cs.
8.4 The Confidentiality obligation shall survive the termination of these T&Cs.
9.1 JFM shall in no event be liable to the Registered Employer or any third party for any inaccuracy, error or omission in, or loss, injury or damage caused in whole or in part by failures, delays or interruptions of www.jobsformumsmalta.com
9.2 The Registered Employer shall remain solely responsible for any misrepresentations, misleading or inaccurate information uploaded by JFM on the Portal or on any other sources and/or provided to the Portal User in any other way. Furthermore, the Registered Employer shall ensure that the Listing Material shall not contain any content that is illegal, obscene, pornographic, profane, fraudulent, misleading, libelous or defamatory, or which breaches in any way any guidelines, regulations and the Laws of Malta.
9.3 JFM shall in no way be deemed responsible, civilly or criminally in any manner whatsoever, for the contents uploaded on the Portal and/or for any breach of the contracts and/or agreements which may potentially by reached by and between the Registered Employer with the Portal User.
9.4 The Registered Employer hereby undertakes to indemnify and hold harmless JFM from any costs and damages suffered as a consequence of the Registered Employer’s breach of its obligations under these T&C or any obligation at law, including any costs and damages suffered in consequence of any third party action brought against the Employer.
10.1 These T&C regulate the relationship between JFM and the Registered Employer and supersede any previous agreement and/or understandings, whether oral or in writing.
10.2 The provisions of these T&C are severable and therefore if any provision or part thereof is held to be invalid, null or enforceable by any competent authority, then such invalidity, nullity or unenforceability shall not affect the validity or otherwise of the remaining provisions.
10.3 JFM reserves the right to amend, alter, delete or add any other provision to these terms and conditions at any time and at its sole discretion without giving any advance notice to the Registered Employer.
11. Governing Law and Jurisdiction
11.1 These T&C shall be governed, construed and interpreted under the Laws of Malta.
11.2 Any dispute, controversy or claim arising out of, or relating to, these T&C shall be settled by the Tribunals and Courts of Malta.
